Microsoft, DOJ Ask For Trial Delay

Microsoft, DOJ Ask For Trial Delay

By Barbara Darrow ,

Attorneys for Microsoft and the U.S. Department of Justice have asked a federal judge to delay the long-anticipated antitrust hearing.

The hearing, to be held by U.S. District Court Judge Thomas Penfield Jackson, was slated to start Oct. 15 and both sides have asked for four additional days, according to a spokesman.

The attorneys need additional time for discovery and depositions, according to a Justice Department source.

Judge Jackson has yet to make a ruling on whether to delay the trial. If the proceedings are delayed the trial will begin Oct. 19.

Last week Judge Jackson said there will be no more delays.
