Intergraph Monday filed a brief in response to Intel's appeal of a preliminary injunction.
Intergraph, which is suing Intel for anticompetitive behavior, patent infringement, and antitrust violations, filed its brief with the U.S. Court of Appeals for the Federal Circuit arguing the court ruled properly when issuing the preliminary injunction.
The injunction, issued on April 10, 1998, by the U.S. District Court, Northern District of Alabama, forced Intel (company profile) to provide Intergraph (company profile) with future plans and early versions of products, in spite of an ongoing patent infringement lawsuit between the two companies.
Intergraph's Monday filing said Intel has failed to show it has suffered under the injunction. In addition, the Intergraph brief said the district court's findings against Intel are substantiated by the Federal Trade Commission's June 8 antitrust lawsuit against Intel. That suit accuses Intel of misusing its monopoly power and engaging in a pattern of antitrust violations.
