this honest hardworking IT guy is just trying to get what he has sweated for. it is just pure bs from the company to refuse his cheque. his company sets themselves up for the attack

It is obvious that sometimes preventing an attack from this type of ex-employee is extremely hard and sometimes, almost impossible. I suppose this should be a lesson learned by all and probably none more so than the attacker himself, who will likely pay for his actions for some time. In my company, there are those employees who have way too much access and should they get ticked, could probably lower the boom on our organization. This is very eye opening.

Typically that "final paperwork" is a non-compete clause and a forfeiture of claims against the company promising not to sue, or defame, or give any disparaging information about the company, to anyone, ever. Whether it be true or not. So, I'd check the facts and find out what he did, or did not, have to sign in order to get his final paycheck.
Regardless - he should NOT have retaliated in any way related to his IT position. He should've gotten an attorney to pursue his paycheck and also sued for penalties and attorney's fees. If it was a small enough amount they would've cut him a check rather than spend the money on a lawsuit. Now he's out the money, and his career, and will probably never see a computer as a professional ever again.
I feel sorry for the guy - he was probably in the right (at least morally) but he went about it in the wrong way.

The second a resignation is tendered by an employee with access to sensitive information his account is disabled and all passwords they had access to, changed.

Yes, he was totally in the wrong. But think of the $30k as a security audit.

Looks like the company has severe rules about resigning. Do they have any security rules? Or like a lot of places: something that they just talk about a lot.

We don't have all the details so for most of this we should reserve judgement. However, Drew is correct that Mr. Nolan should have pursued a more rational course. He threw a tantrum like a two year old spoiled brat. If he had put two minutes of actual thought about consequences into the decision instead of only thinking of ways to get even or to get ahead, there is a good chance he would have his money now.

Unless he signed an employment contract requiring him to execute that document upon termination, the wage & hour laws about final checks are pretty clear. The company would not have a leg to stand on.

Once again, an individual has become judge and jury. Our system, flawed as it is, generally works, many times not quickly or efficiently, but finally.

He reacted to an unlawful act by executing his own unlawful act. He needs to bear the consequences. We already have enough criminals running around free, with the knowledge that the system cannot punish them adequately (or won't) and against whom the honest law-abiding individual has no defense.

Those who justify his actions are part of the problem.

Yes can understand the frustrations, just almost like postal, I worked there for a long time, never seen so many employees complain so much. To hard of work and not enough money and way to many rules...........don't they get it..how much does it really cost them in the end

I wonder how long after he got canned that he decided to infiltrate their system...Sometimes you just need to wait before you go digitally postal. I had a similar situation where my former employer really dug their knife deep into my back after I was gone. Unapparent to them I had left several holes in which can be dealt with in the future. It could be months...it could be years. Patience is virtue. I say good luck to them and their data.

This could have been avoided if the HR department had proper procedures in place on how to terminate an employee with dignity and how to allow an employee to resign with dignity. Harming a person financially is a sure way to get backlash.

My question is... how can he now work for a billion dollar company and have the IT staff allow him to work with peoples personal information...
